Terms of Service

The terms on which tour operators use the Kapuli platform, and on which guides and guests use the Kapuli mobile app.

1. Agreement

These terms are between you and Kapuli, Inc. Using the platform or the mobile app means accepting them.
Kapuli is currently in closed beta. Access to the platform is granted after a conversation, not by self-service sign-up.
The mobile app is free to download and use on iOS and Android, and is included in full with every plan.

Plans are billed monthly. Solo is $29 per month, Boutique is $299 per month, and Enterprise starts at $2,999 per month.
Plans are bounded by active departures: up to 12 on Solo, 13 to 49 on Boutique, and 50 or more on Enterprise. An active departure is a dated departure that is open for booking or currently running.
Users are not charged per seat. Solo includes one user, Boutique five, and Enterprise unlimited.
You may move up a plan at any time. Changes take effect from the next billing period.

On Boutique and Enterprise you connect your own payment processor. Kapuli takes no commission on your bookings and never holds your travellers' funds.
On Solo, payments are processed by Kapuli and carry a 2% booking fee.
You are responsible for the accuracy of the prices, deposits, taxes and cancellation terms you configure, and for honouring them with your travellers.

You retain ownership of your website content, your trip material, your traveller records and your bookings.
You grant Kapuli the licence needed to host and display that content in order to run your booking site and platform.
The booking experience runs under your own domain and brand. Kapuli branding does not appear to your customers.

On Boutique and Enterprise, we migrate your existing website within four weeks of signature, preserving your content, your URLs and your search ranking.
Ongoing maintenance is provided by a dedicated forward deployed engineer: 20 hours per month on Boutique, 160 on Enterprise. Unused hours do not roll over.
Migration and dedicated maintenance are not included on Solo.

Do not use Kapuli to break the law, to infringe someone else's rights, or to publish content you have no right to publish.
Do not attempt to access another operator's data, disrupt the service, or reverse-engineer the platform.
Journal content posted in the mobile app must respect the privacy of the other people on the trip.

KapSight species identification is provided as an aid, not as an authority. Identifications are probabilistic and should be treated as such.
Naming individual animals is currently live at Panna Tiger Reserve in Madhya Pradesh, India, and is available by invitation while further reserves are added.
Location data attached to sightings of protected species may be withheld or coarsened where publishing it would put an animal at risk.

We aim to keep the platform available continuously and will give notice of planned maintenance.
Support is by email at support@kapuli.ai, answered within one business day, alongside the engineering hours included in your plan.
Beta means some features arrive early and change. We will not remove something you depend on without telling you first.

You may cancel at the end of any billing period. We will provide a complete export of your data.
We may suspend an account for non-payment or for a serious breach of these terms, after notice and a chance to put it right.
Bookings already taken must still be honoured by you after termination.

Kapuli is provided without warranties beyond those that cannot be excluded by law.
Our aggregate liability is limited to the fees you paid in the twelve months before the claim.
These terms are governed by the laws of the state in which Kapuli, Inc. is incorporated, without prejudice to mandatory consumer protections in your own jurisdiction.
